MODIFIED ACP

The suggestion made by the unions is under consideration of the Directorate. FNPO has suggested that orders of the Directorate should set an example covering TBOP/BCR so that Circles may implement orders without any doubt. On 24/06/09 Secretary General FNPO had detailed discussion with DDG (Est.) and urged for early clear orders.


PATNA CASE Re-VERIFICATION

The case did not come on 23/06/09. No stay was granted in favour of Bharatiya Union. The case will come up next month. FNPO & NFPE have engaged a lawyer to oppose the case.

The Dopt Approved Annual Direct Recruitment for the years 2006 & 2007 - Total 5190 posts

You may be aware that the CHQ has been pressing the department to fill up the ADRs for the years 2006-2007 when the department issued ADR for the year 2008 .The Department of Posts had taken up this issue with the DoP&T for revival of the posts for the year 2006 and 2007 and the DoP&T approved the same. Now. totally 5190 posts are sanctioned under the ADR plan for the years 2006 & 2007. The Department will apportion posts cadre wise and is expected to issue orders As Soon possible.

The CHQ urged the Department now to fill up ADR vacancies for the year 2006, 2007, 2008 and even for this year 2009 in one recruitment in the coming months. You may please note that for the year 2009 all the vacancies can be filled up whereas for other years only 1/3rd posts can be filled up.  but CHQ is Convincing Department of post to fill all the Vacant post of postman & Gr ” D ” from Year 2006,2007,2008

1) All vacant post of Postman since year 2005 to 2009 should be filled in; as these post are promotional post for GDS cadre and are out of preview of screening committee.

2) All vacant Post of Mail peon/peon since year 2005 to 2009 should be filled in as these posts are also promotional posts for GDS cadre and casual labours and are out of preview of screening committee and deptt can fill up all these posts.

3) Temporary status gr ” D ” working since last 15 to 20 years should be absorb on vacant post of mail peon / peon. Those who are SSC passed may be absorb on seniority cum fitness basis and non matriculates should be absorb with literacy test.

4) Keep the orders of Additional duties of postman. Mail peon /peon held in abeyance at present as due to non – filling of vacant post of postman staff they are under heavy pressure of work so as mail peon/ peon Union request that after filling of all vacant post this issue can be discussed & then this additional work can be carried out by staff.

Agitational Programme

Postal Joint Council of Action has called for Agitational Programme in two phases protesting against the department’s indifferent attitudes towards GDS cadre. The Dep. is adopting delaying tactics in implementing GDS Committee Report.

The first stage is nationwide
DHARNA at all level on 29th June 2009, the Monday.

The second stage is massive
DEMONSTRATION in front of Postal Directorate, Dak Bhawan , New Delhi on 03rd July 2009, the Friday on the day of opening of Budget Secession in the Parliament.

Circle Secretaries and Divisional Secretaries are requested to act fast and vigorously campaign at Division/Branch level and mobilise strength in full and make the agitational programme a grand success.

MASSIVE DHARNA / MASS DEMONSTRATION ON THE OPENING OF BUDGET SESSION OF PARLIAMENT

The Postal JCA of NFPE and FNPO Federations call upon the entirety of Postal Employees to organise a massive Dharna jointly under the banner of Joint Council of Action on 29.06.2009 at the level of Divisions / Branches for calling the attention of the Department of Posts to the following burning issues. As far as the Delhi Circle is concerned, there shall be a massive demonstration in front of Dak Bhawan during lunch hour on 3.7.2009, the first day of Budget Session of Parliament. A Memorandum on the following items shall be submitted to the Honourable Minister of Communications & IT and Honourable Minister of State for Communications & IT by the JCA on 3.7.2009. 

The Burning issues that shall receive focus:

1). Early implementation of GDS Committee recommendations with the suggestions of staff side duly incorporated.
.
2).  End discrimination in bonus quantum ceiling between regular and GDS as per the Bonus Act amendment.

3).  Remove the arbitrary cap of 60 days in PLB for Postal Employees.
.
4).  Fill up ADR vacancies of 2005-06 & 2006-07 in all wings and of all cadres including Multi Skilled employees.
.
5).  Expedite Cadre Review of all cadres in Department of Posts.
.
6).  Stop abolition of Postmen posts and beats and stop harassment of delivery staff and instructions in violation of P&T Manuals in Project Arrow Offices.
.
7).  Cancel the order for compulsory pay disbursement through bank cheques and direct credit system.
.
8).  Re-fix the eligibility for OTA proportionately to the 6th CPC wage level and clear all pending OTA bills.
.
9).  Re-fix the wages of all Casual labourers and Part Time Contingent / RRR employees on the basis of the 6th CPC wages.
.
10).  Grant Child Care Leave to all eligible Women Employees.

Eight-Digit PIN to be used soon

India Post is going to introduce eight digits PIN CODE in place of the present six.
The extra two digits will indicate the postman beat in which the letters are to be delivered.

The current PIN code contains details up to the Post Office of delivery. The first digit of the PIN code indicates one of the eight Postal Circles in the country. The second digit indicates the sub-region and the third shows the district code. The last three digits refer to the delivery post office. Now, two more digits code will be added to indicate the Postman beat to facilitate easier and faster sorting of letters.

According to learned counsel for the petitioner, the communication Annex P/4 was issued on 17th April, 2009 and by this letter it has been communicated that letter of authorization is to be sent through the applicant Services Association to which membership is sought so as to reach the Drawing and Disbursing Officer concerned on or before 15.5.2009. According to learned counsel for the petitioner, the said communication dated 17th April, 2009 was not sent to the petitioner – association and when petitioner-association came to know about the same, the petitioner-association requested the Chief Post Master, Rajasthan, Jaipur for giving copy of the communication Annex, P/4 dated 17th April, 2009 vide letter dated 12th May, 2009. On this request, the communicated dated 17th April, 2009 was given to the petitioner-association and the petitioner-association by his has not been given reasonable opportunity, rather say, reasonable time to comply with the conditions of sending the letters of authorization as required by Annex, P/4.

Looking to the totality of the facts of the case, Issue notice to the respondents for final disposal.

Meanwhile, the respondents shall not finalize the re-verification of membership for recognition of services Association till further orders.

GENERAL SECRETARY ON TOUR

General Secretary NUPE P-N on tour to UP and Bihar circle during June 2009 as detail below

During 10 to 11 June visited Lucknow attended All India Conference of NUR-N visited Lucknow GPO, Lucknow Chowk HO pincode 226003 aligning PO pincode 226024 Nirala Bazar Popcode 226020 and discussed various problems with Postman and group “D” Staff. The Postmaster General Lucknow was not available as such met with DPS HQ Shri Sachin Kishore and discussed on various problems. Shri Hanuman Prasad Dy Circle Secretary Shri Parshuram Gupta Divl Secretary Lucknow & Shri R S Yadav circle secretary NUPE P-III was with General Secretary.
On 12th June 2009 G/S visited Varanasi HQ and Varanasi Cantt PO and discussed with staff in regards of their problems and they met with Shri R. K. Mishra SSP Varanasi east Divn and SP Varanasi west divn and discussed in details the staff problems of Varanasi and both the officers assured to look into those staff problems.
 During 13th to 17th June G/S is on tour in Bihar circle. He visited Patna GPO and addressed the large numbers of staff attended meeting. He attended Sitamadhi divisional conference along with circle working committee of NUPE P-N Bihar circle on this occasion 70% of NFPE members joined national union in his presence. So also near about 200 to 300 GDS staff is going to join GDS national union. The tour was a grand success.

Item No. 6.1: In this item the member employees is not able to follow the beneficial up gradationFor him as per be ibid. It is said that ‘he shall be entitled to draw his arrears of pay onlyFrom the date of his option ie the date of financial up gradation under MACPs.’ It is not understood Whether the arrears of pay would be from the date of option in earlier MACPs up gradation or In revised pay structure.
Item No. 4: ‘After availing financial up gradation under MACPs, if to the grade of
Rs. 2400 on regular promotion, he will only be granted the difference of grade pay betweenRs. 2000 and Rs. 2400. No additional increment will be granted at this stage.’In this connection, when the Government Servant is found fit for promotion he is entitledFor 3% regular increment under FR-22(1)(a)(1) and also the difference in grade pay. It is notUnderstood has to why he will not get 3% increase on regular promotion under the above FR.
Clarification may be given.
The financial up gradation on non-functional basis is subject to fitness, in the hierarchy ofGrade pay within the PB-1 and Grade Pay upto Rs. 4600/-. Thereafter for up gradation under theMACPs the benchmark of ‘good’ would be applicable till the grade pay of Rs. 6600/- in PB-3.
The benchmark will be ‘very good’ for financial up gradation to the grade pay of Rs. 7600 andAbove.Alongwith the above referred communication, illustrations is given relating to LDC, similarillustration is requested for the staff in Postman and Group ‘D’ staff.
  It is requested that necessary clarification as requested above may kindly be given early toConvince my member staff to give their full consent for acceptance.

Standard deduction for salaried employees may return

Ahead of the annual budget, here’s some cheer for salaried employees and pensioners. The finance ministry is considering bringing back standard deduction of up to Rs 20,000 in individual taxable incomes. 
According to revenue department officials, the government may be willing to take a small hit in return for a spike in spending that it hopes will result from a bigger disposable income with the salaried classes. 
Till the budget for 2005-06, a standard deduction of Rs 30,000 or 40 per cent of income, whichever was lower, was allowed to salaried employees with an annual income between Rs 75,000 and Rs 5 lakh. For those earning more, the standard deduction was fixed at Rs 20,000. 
The standard deduction was meant to compensate salaried people for the fact that self-employed small business persons or entrepreneurs paid tax only on their net income after deducting business expenditure. 
Industry has been demanding the re-introduction of standard deduction so that individual taxpayers are able to spend more and stimulate domestic demand. As Indira Gandhi’s finance minister, Pranab Mukherjee had in fact, raised it from Rs 5,000 to Rs 6,000 in the budget for 1983-84. 
“There are two ways of looking at reducing personal tax. One option before the government is to do away with surcharges. The other option would be to give relief to individual earnings up to a particular level. In other words, keeping in mind fiscal deficit constraints, the benefit could be extended to only lower income earners. 
This would help reduce administrative burden of the department and focus on the big fish,” said Sudhir Kapadia, Partner, Taxation, Ernst & Young. P Chidambaram had as finance minister removed the standard deduction after overhauling tax slabs and raising the exemption limit to Rs 1 lakh. He had introduced three slabs of 10 per cent, 20 per cent and 30 per cent for individuals in the Rs 1 lakh to Rs 1.5 lakh income bracket, Rs 1.5 lakh to Rs 2.5 lakh and over Rs 2.5 lakh respectively.

“Standard deduction should be restored,” the Institute of Chartered Accountants of India (ICAI) said in its pre-Budget memorandum to the government.



THE GDS COMMITTEE IMPLEMENTATION

The file is still under consideration of the Ministry of Finance. The process of clearance by MOF, DOPT, Law Ministry and then Cabinet approval would take some more time. However it is ascertained that the implementation of GDS Committee recommendations would be only on allocation of funds after the Budget in July 2009.
