The All-India CPI-IW for Nov, 2023 increased by 0.7 points and stood at 139.1 (one hundred thirty-nine point four), as per the press release by the Labour Bureau on 29th December 2023. Expected DA/DR from January, 2024 is accounted for in the 5th step with this release. This increase in the CPI-IW Index still results in a 4% increase in DA/DR from January 2024 for Central Government Employees and Pensioners, reaching 50% in the 7th CPC DA/DR. The CPI-IW index in the coming months will confirm the exact figure of DA/DR for January 2024. Expected DA/DR from January 2024 will increase to 50%, subject to further increases in the coming months’ CPI-IW.

श्रम ब्यूरो द्वारा 31 दिसम्‍बर 2023 को जारी प्रेस विज्ञप्ति के अनुसार, नवम्‍बर 2023 के लिए अखिल भारतीय सीपीआई-आईडब्ल्यू में 0.7 अंकों की वृद्धि आई और यह 139.1 (एक सौ उनतालीस अंक एक) रहा। जनवरी 2024 से अपेक्षित डीए /डीआर को इस रिलीज के साथ चौथे चरण में प्रवेश कर गया है। सीपीआई-आईडब्ल्यू इंडेक्स में यह वृद्धि अभी भी केंद्र सरकार के कर्मचारियों और पेंशनभोगियों के लिए जनवरी 2024 से डीए/डीआर में 4% की वृद्धि आकलित है, जिसके परिणामस्वरूप 7 वें सीपीसी डीए / डीआर 50% तक पहुंच गई है। आने वाले महीनों में सीपीआई-आईडब्ल्यू इंडेक्स जनवरी 2024 के लिए डीए/डीआर के सटीक आंकड़े की पुष्टि करेगा। जनवरी 2024 से अपेक्षित डीए/डीआर बढ़कर 50% हो जाएगा, जो आने वाले महीनों के सीपीआई-आईडब्ल्यू में और वृद्धि के अधीन होगा।

Consumer Price Index for Industrial Workers (2016=100) — November, 2023

The Labour Bureau, an attached office of the M/o Labour & Employment, has been compiling Consumer Price Index for Industrial Workers every month on the basis of retail prices collected from 317 markets spread over 88 industrially important centres in the country. The index is compiled for 88 centres and All-India and is released on the last working day of succeeding month. The index for the month of November, 2023 is being released in this press release.

The All-India CPI-IW for November, 2023 increased by 0.7 points and stood at 139.1 (one hundred thirty nine point one). On 1-month percentage change, it increased by 0.51 per cent with respect to previous month whereas it remained stationary between corresponding months a year ago.

The maximum upward pressure in current index came from Food & Beverages group contributing 0.65 percentage points to the total change. At item level, Rice, Wheat, Wheat Atta, Jowar, Arhar Dal/Tur Dal, Urd Dal, Eggs-Hen, Gingelly oil, Coconut fresh with Pulp, Carrot, Drum-stick, French beans, Garlic, Lady’s Finger, Onion, Tomato, Sugar-White, Cumin seed/Jira, Cooked Meals, Zarda/kimam/Surti/Gutka, Leaf Tobacco, Tailoring Charges, Trouser Pants readymade, Leather Sandal/Chappal/Slippers, Electricity Charges (Domestic), Books-School/ITT, Tuition and other fees-College, etc. are responsible for the rise in index. However, this increase was largely checked by Fish Fresh, Poultry/Chicken, Soyabean oil, Sunflower Oil, Apple, Banana, Grapes, Orange, Capsicum, Cauliflower, Chillies Green, Ginger, Lemon, Peas, Medicine Allopathic, etc. putting downward pressure on the index.

At centre level, Tirunelveli recorded a maximum increase of 4.1 points. Among others, 3 centres recorded increase between 3 to 3.9 points, 5 centres between 2 to 2.9 points, 19 centres between 1 to 1.9 points and 36 centres between 0.1 to 0.9 points. On the contrary, Gurugram recorded a maximum decrease of 1.5 points followed by Ahmedabad and Kollam with 1.0 point each. Among others, 18 centres recorded decrease between 0.1 to 0.9 points. Rest of three centres’ index remained stationary.

Year-on-year inflation for the month stood at 4.98 per cent compared to 4.45 per cent for the previous month and 5.41 per cent during the corresponding month a year before. Similarly, Food inflation stood at 7.95 per cent against 6.27 per cent of the previous month and 4.30 per cent during the corresponding month a year ago.

OFFICE MEMORANDUM

Subject: Reservation in promotion to Persons with Benchmark Disabilities (PwBDs) regarding.

 

The undersigned is directed to say that the Hon’ble Supreme Court, vide its Judgement dated 30.6.2016, in the WP(C) No.521/2008, titled ‘Rajeev Kumar Gupta Vs. U01, had directed the Government to extend three percent reservation to PWD in all identified posts in Group A and Group B, irrespective of the mode of filling up of such posts. However, subsequently the Hon’ble Supreme Court, vide its Order dated 3.2.2017, in the Civil Appeal No. 1567/2017 titled Siddaraju Vs. State of Karnataka & Ors.’ referred to the prohibition made against reservation in promotion as laid down by the majority in Indra Sawhney & Others v. Union of India & Others (1992) and observed and held that its Judgement dated 30.6.2016 in Rajeev Kumar Gupta needed to be considered by a larger Bench. However, the Hon’ble Supreme Court finally disposed of the Siddaraju matter vide its Judgement dated 14.1.2020 and held that its Judgement in Rajeev Kumar Gupta would bind the Union and State Governments and it must be strictly followed.

 

2. However, the Union of India needed some clarification with regard to the implementation of the Hon’ble Supreme Court Judgement dated 30.6.2016 and 14.1.2020, and, therefore, Application for Clarification was filed by the UOI before the Hon’ble Supreme Court seeking clarification which inter alia included whether the vacancies for promotion for PwDs would be computed only on the basis of the vacancies against the identified posts or against the vacancies in both identified and non-identified posts and whether the judgement dated 14.1.2020 needs to be implemented on the basis of PwD Act, 1995 or RPWD Act, 2016. Hon’ble Supreme Court disposed of this Application for Clarification vide its Order dated 28.9.2021 directing the Government of India to issue instructions regarding reservation in promotion as provided in Section 34 of the RPwD Act, 2016.

 

3. Proviso to Section 34 of the RPWD Act, 2016 provides that the reservation in promotion shall be in accordance with such instructions as are issued by the appropriate Government from time to time. Accordingly, DoPT vide its OM of even number dated 17.5.2022 issued detailed instructions for extending the benefit of reservation in promotion to PwDs up to the lowest rung of Group A’ in posts and services under the Central Government. This OM is effective with effect from the date of its issue i.e. 17.5.2022.

 

4. However, in a Contempt Petition (Civil) No.873/2023 filed by Shri S. S. Sundaram against Department of Revenue, the Hon’ble Supreme Court vide its order dated 18.7.2023 has directed “Though it is pointed out that the judgement of this Court of which breach is alleged, has been complied with effect from 1572023, the fact remains that the judgement is of 30.6.2016 directing the respondents to implement the 1995 Act. Therefore, the respondent will have to consider of giving at least notional promotion to those who are eligible from an earlier date’.

 

5. The aforesaid directions dated 18.7.2023 of the Hon’ble Supreme Court has been considered in consultation with the Department of Legal Affairs and it has been decided to grant notional promotions to the PwD candidates w.e.f. 30.6.2016 as under:

 

(i) PwD employees in posts and services of the Central Government, will be considered for grant of the benefit of reservation in promotion up to the lowest rung of Group ‘A’ on notional basis w.e.f. 30.6.2016 subject to their fulfillment of the eligibility conditions as laid down in the DoPT OM of even number dated 17.5.2022 regarding reservation in promotion to PwDs. However, the extent of reservation in promotion may be in accordance with the relevant provisions contained in the PwD Act 1995 and RPWD Act 2016. Further, this benefit may be extended after holding Review DPC as per the extant instructions issued by DoPT on the subject. In case the PwD employees are found eligible and suitable for promotion from any date subsequent to 30.6.2016, then the benefit of reservation in promotion may be extended to them from the date they become eligible for promotion. This promotion on notional basis includes promotion on seniority quota as well as Departmental Examination/Departmental Competitive Examination. In case of Departmental Examination/Departmental Competitive Examination, which has already been held during the period from 30.6.2016 to 16.5.2022, the eligibility of the PwD candidates may be assessed on the basis of their performance in the said examination. The concerned Administrative Authorities are given discretion to consider holding of special examination for assessing the suitability or eligibility of PwD employees for such Departmental Competitive Examination.

 

(ii) Any such promotion during the period from 30.6.2016 till the PwD employee actually assumes the charge of the post will be only on notional basis and the actual financial benefit of promotion will be effective to them with effect from the date they, actually assume charge of the promoted post, meaning that no financial arrears will be admissible to them for the period from the date on which they get the benefit of notional promotion and the date on which they actually assume or have already assumed the charge of such promoted post.

 

(iii) Extending the benefit of reservation in promotion to the PwD employees on notional basis between 30.6.2016 and actual assumption of the charge of the post may affect the inter-se-seniority of the officials in various grades. Due to this, there may be cases in which some officials may have to be placed in a select list/seniority list, subsequent to the year of their existing/present seniority list/select list. This may have a chain effect as it may result in revision in seniority lists in subsequent years in many cases which may cause administrative inconvenience. In order to avoid such situation, supernumerary posts may be created to adjust the lien of such PwD employees with effect from the date on or after 30.6.2016, when they become eligible to get the benefit of reservation in promotion, till the availability of vacancy in which the promotion is to be made or till they vacate the post on their retirement, further promotion etc. whichever is earlier.

 (iv) The creation of supernumerary post, as stated above, will be personal to the PwD employee who is given the benefit of reservation in promotion on notional basis and such supernumerary post will stand abolished on the date when such PwD employee is adjusted against available vacancy in the grade in which the promotion is given or when that PwD employee vacates the post on his/her retirement, further promotion etc., whichever is earlier.

 (v) Ministries/Departments are advised to undertake an exercise to ascertain the requirement of supernumerary posts required by them and submit the proposal for creation of posts to the Department of Expenditure through DoPT. Such proposal shall contain the proposal in respect of the entire Department/Ministry and the proposal in piecemeal shall not be accepted. A certificate to the effect that the proposal is complete in all respects and the requirement of creation of supernumerary posts has been projected in respect of the entire Department may also be furnished along with the proposal. Further, each proposal shall have the concurrence of the Liaison Officer for PwDs of the Department/Ministry concerned and shall be forwarded with the approval of the Secretary of the Administrative Department/Ministry.

 (vi) It is clarified that the benefit of notional promotion, as proposed above, shall not adversely affect those PwD candidates who have already been granted the benefit of reservation in promotion in personam in pursuance of the Orders/judgements of various Courts of Law.

 6. This issues with the approval of Department of Expenditure conveyed vide their ID Note No.7(1)/E. Coord.I/2017 Part (V) dated 12.12.2023.

A meeting was held under the chairpersonship of Additional Secretary (Pers. Policy) on 15th December, 2023 at 1.00 PM at North Block, New Delhi to discuss the 13 agenda items of 62 nd Standing Committee meeting. List of participants is at

Annexure I.

2. At the outset, the Deputy Secretary (JCA) welcomed the participants and gave the background for convening the meeting. He informed that during the 62nd meeting of the Standing Committee of the National Council held on the 20th September, 2023, it was decided with the approval of the Chairperson (Secretary, Personnel), that the 13 items carried over from the 61st Standing Committee meeting would be discussed in a separate meeting to be chaired by Additional Secretary (PP). As such the current meeting was scheduled. In his introductory remarks, the Chairperson welcomed the participants to the meeting. The Chairperson said that minutes of the 62™ standing committee meeting have been Missued and the decisions taken should be complied with and action report sent to DoPT. He also emphasised and requested the representatives of Ministries and Departments to hold regular meeting with staff side. Thereafter Secretary (Staff Side) and Leader (Staff Side) also welcomed and addressed the participants. The key points made by them during their welcome addresses are at Annexure -II.

 3. The agenda items and decisions taken thereon are given below.-

 (i) Item No.17/SC/22: Strengthening of grievance redressal mechanism. (D/o Pension & PW and D/o AR & PG)

 The Director, D/O P&PW gave details on the number of measures taken by the department to strengthen the grievance redressal mechanism for pensioners. He explained that a monitoring system for the progress of grievance disposal was in place. Regular inter-ministerial meetings are held for progress monitoring. Pensioners are informed about case developments through SMS, and feedback from pensioners is obtained. Additionally, he highlighted a comprehensive OM dated August 23, 2023, issued to all Ministries and Departments, emphasizing that cases should be treated and disposed of only after conclusive resolution. DS, D/o AR&PG mentioned the revamping of the mobile version of CPGRAM for increased user- friendliness.

 The Staff side raised the issues about pensioners’ lack of awareness and poorconnectivity in remote areas. The Staff side also raised the issue of departmental council meeting pending for long in D/o P&PW. After deliberation, the following was decided:

 1) D/o P&PW would ensure display of calendar for pension adalats on the website of the Ministries/departments and stress upon both quantitative and qualitative grievance disposal.

 2) D/o P&PW and D/o AR&PG to raise awareness among pensioners about the grievance redressal mechanism.

 3) There should be regular departmental council meetings and an early meeting by D/o P&PW with the staff side to address pending issues would be held.

 4) Dio P&PW will share the OM dated March 23, 2023, with the Staff side.

 (ii) Item No. 6/SC/22: Restoration of the commuted portion of pension after 12 years of service.(D/o Pension &PW)

 The staff side demanded for restoration of the commuted portion of pension after 12 years of service. D/o Pension & PW informed that a proposal for reduction in restoration period of commutation was referred to the Department of Expenditure. However, D/o Expenditure returned the proposal stating it to be premature. DS, D/o Expenditure clarified that they had received a proposal from the Department of P&PW proposing that the matter relating to reduction in the restoration period for commuted pension maybe referred to the next CPC. As the CPC has not yet been constituted, the proposal was returned. It was decided that the Department of Pension & PW may consider sending a fresh proposal to Department of Expenditure. If required Department of Expenditure may convene a meeting with the Staff Side.

 (iii) tem No. 14/SC/22: Payment of FMA to Employees and Pensioners of the National Institute of Ayurveda and bring the employees of the institutes within the ambit of CCS (MA) rules.(M/o AYUSH) Dir, M/o AYUSH informed that an SLP was filed in the Hon’ble Supreme Court of India. Hon’ble Supreme Court of India vide order dated 08.01.2021 stayed the operations of the impugned orders passed by Hon'ble CAT and Hon'ble High Court of Rajasthan. The case is pending and yet to be listed for further hearing in Supreme Court. It was suggested that this matter may be reviewed at the level of Secretary, M/o AYUSH in the light of orders passed by Hon'ble CAT and Hon’ble High Court of Rajasthan and a decision may be taken regarding contest or withdraw of the SLP in the matter.

 (iv) Item No. 3/19/SC: Maximum coverage under the Deposit Linked Insurance Scheme (Insurance Scheme for Central Government Employees) may be increased from Rs. 60,000 to Rs. 6.00 lakh. (D/o Expenditure) It was observed that this item was considered in the 62 nd meeting of Standing Committee and in view of the justification put forth by the staff side, it was decided to reconsider the issue in Department of Expenditure. DS, D/o Expenditure informed that they were waiting for the proposal in this regard from D/o P&PW. It was decided that the staff side will submit a proposal with justification to D/o P&PW who will examine it and refer to D/o Expenditure.

 (v) Item No. 28/SC/22: Restoration of facilities and concession withdrawn by Railways to Senior Citizens. (M/o Railways) JD, M/o Railways, informed that the Government gave subsidy of Rs. 59,837 crores on passenger tickets in 2019-20. This amounts to concession of 53% on an average, to every person, travelling by Railways. This subsidy is continuing for all passengers. Further concessions beyond this subsidy amount are continuing only for the categories of Divyangjans, Students and patients. At present there is no proposal to restore concession to senior citizens. In view of the position explained by the Ministry of Railways, it was decided to close this item.

 (vi) Item No. 11/SC/22: Pension to be exempted from the purview of income tax. (Dio Revenue, CBDT) On the demand for exemption of pension from Income Tax, D/o Revenue, informed that policy of the Government is to simplify the Income Tax Act, 1961 by removing exemptions and incentives, while, at the same time reducing the rates of taxes. Therefore the proposal could not be agreed to. It was decided to close the item.

 (vii) Item No. 24/SC/22: Disability pensions of war heroes to be exempted from Income Tax. (Dio Revenue) The Staff Side demanded that the Disability pensions of war herces be exempted from Income Tax. D/o Revenue informed that a court case on the subject is pending before the Hon’ble Supreme Court and the Hon'ble Court, in its Order dated 30.08.2019, has directed to maintain status quo, pending further consideration. It was decided to wait for the outcome of the case. Meanwhile the item stands closed.

 (viii) Item No. 29/19/SC: Enhancement of Bonus ceiling limit of casual labourers consequent on enhancement of Bonus ceiling of casual Central Government employees. (D/o Expenditure) With regard to the demand of the Staff Side to enhance bonus for casual labourers, it was noted that earlier in the 61th Meeting of the Standing Committee, Department of Expenditure had informed that they needed data on the number of casual workers working in Ministries and Departments to take a policy decision. It was also decided in that meeting that Staff Side would furnish the requisite information. The Department of Expenditure informed that this data was still awaited from

 Departments/Ministries. It was decided that a communication seeking requisite data will be issued by Department of Expenditure to the Departments/Ministries and a copy of the same will also be shared with the Staff Side.

 (ix) Item No. 21/21/SC: Grant of Risk Allowance to Central Government employees including Defence Civilian Employees w.e.f., 1/7/2017 and inclusion of new hazardous activities in the list for grant of Risk Allowance. (DOP&T)

 It was noted that DoP&T has issued orders for grant of Risk Allowance at revised rates w.e.f. 3/11/2020. Department of Expenditure was of the view that this benefit cannot be given with retrospective effect. The Staff Side brought to the notice that there was a disparity of risk allowance rates between the Fire Service empeloyees and the employees of Defence and Railways engaged in hazardous activities. It was also brought to the notice by the Staff Side that Ministry of Railways and Department of Defence had constituted a Committee in this regard. It was decided to take up this matter with Ministry of Railways and Ministry of Defence.

 (x) Item No. 8/SC/22: MACP to be made effective from 1.1.2006 in implementation of the judgment of the Supreme Court. (DOP&T) On the demand regarding implementation of MACP w.e.f. 1.1.2006, as has been done in the Defence Ministry on the basis of the judgment of the Supreme Court, it was informed that the Supreme Court in its Orders dated 05.03.2020 and 28.04.2021 overturned its earlier Order, dated 08.12.2017 which allowed grant of MACP with effect from 01.01.2006 in the case of Balbir Singh Turn and others, which formed the sole ground for the claim to extend similar benefit to Central Govt. civilian employees. An OM dated 13.7.2021 from DoPT has been issued advising to dispose of cases in the light of Supreme Court Judgement.

 It was noted that judgement of the Supreme Courtwas discussed with Department of Expenditure and Department of.Legal Affairs. However, in view of the categorical directions by the Court, the demand could not be agreed to. lt was decided to close the item.

 (xi) Item No. 9/SC/22: Grant of one notional increment for those who retired on superannuation on 30th June (DOP&T)

 It was noted that in CA No. 2471 of 2023 @ SLP (C) No. 6185/2020, the Supreme Court in its Orders dated 11.04.2023 had given judgement in favour of petitioner and subsequent SLP filed by the Government had been dismissed by the Supreme Court. It was informed that the judgement of the Supreme Court was under consideration in DoPT in consuitation with nodal ministries. The Staff Side urged to expeditiously resolve the issue and issued necessary Government orders.

 

(xii) tem No. 10/SC/22: Applicability of the 7th CPC Pay revision benefit for those retired on 31.12.2015 (DOP&T) With regard to the demand for applicability of the 7th CPC Pay revision benefit for those retired on 31.12.2015, it was noted that an SLP on the subject was pending with the Supreme Court. Since the matter is sub-judice, the item may be closed.

 (xiii) Item No. 23/SC/22: To specify timeframe for the completion of disciplinary cases in the case of pensioners. (DOP&T) It was noted that Department of Personnel and Training (DoPT) is already seized of the matter and there is a focus on addressing various issues and considering adjustments to the definitions of minor and major penalties. The primary goal is to simplify procedures, especially for minor penalties, ensuring a more prompt. resolution. To ensure timely resolution, extensive work is underway on multiple fronts. A dedicated working group within DOPT has submitted a comprehensive report which is under consideration. There is a commitment to streamline the procedure so that disciplinary proceedings against the pensioners are, by and large, concluded within a maximum period of three years. It was decided to close the item.

 Other items raised by the Staff Side :- Anomalies and implementation of DOP&PW OM dated 03.03.2023 Staff Side drew attention towards several anomalies crapped up from the DOPP&W OM dated 03.03.2023 regarding option for conversion from NPS to OPS.

 Moreover, in the lower formations / field units the above OM is being not properly implemented.

 a. In case of Ex Apprentices of Railways and Defence who were recruited directly on batch wise seniority basis, there is no notification / advertisement and hence the vacancies Sanctioned for recruitment prior to 22/12/2003 Should be treated as notification. This is not happening in the units.

 b. In the case of Compassionate Appointment also there is no notification and hence the employees recruited on the basis of the Call Letters issued to them / date of application for compassionate appointment etc should be treated as notification. This matter is also remaining unsettled.

 c. In some cases the senior employees are kept in NPS and the junior employees are converted to Old Pension Scheme.

 It was decided that DOP&PW will hold a meeting with the Staff Side to resolve the issues represented by the Staff Side.
