RATES OF DEARNESS ALLOWNCES APPLICABLE W.E.F. 1.1.2010 IN THE PRE-REVISED SCALE OF PAY [5TH CPC] VIZ., 87% DA HAS BEEN ORDERED BY THE MOF FOR WAGES OF CASUAL LABOURERS & CONTINGENT EACH

Casual labourers who are not yet granted with the Minimum of 6th CPC Wages will get the benefit of at least the Dearness Allowances included in their wages. The issue of applying 6th CPC wages is pending with the JS&FA for a decision. Anyway our colleagues can take advantage of the undermentioned order to at least get the refixation of wages of Casual labourers / Contingent etc on the basis of full DA installments granted to Government Employees. The orders of the MOF as endorsed by the Department of Posts is reproduced below:

OFFICE MEMORANDUM

Subject:- Rates of Dearness Allowance applicable w.e.f. 1.1.2010 to the employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised scale as per 5th CPC.

The undersigned is directed to refer to this Department's O.M. of even No. dated 29th September, 2009 revising the Dearness Allowance w.e.f. 1.7.2009 in respect of employees of Central Government and Autonomous Bodies who continue to draw their pay and allowances in the rpe-revised scales of pay as per 5th Central Pay Commission.
2. The rates of Dearness Allowance admissible to the above categories of employees of Central Government and Central Autonomous bodies shall be enhanced from the existing rate of 73% to 87% w.e.f. 1.1.2010. All other conditions as laid down in the O.M. dated 3rd October, 2008 will continue to apply.
3. The contents of this Office Memorandum may also be brought to the notice of the organizations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.

HAIL THIS LEGAL VICTORY

HERE IS A NEWS FLASH - THE WRIT PETITION FILED BY BPEF UNION IN MADRAS HIGH COURT AGAINST THE TRADE UNION FACILITY OF P3 UNIONS OF NFPE & FNPO AND IRM&ASRM UNION STANDS DISMISSED TODAY.

Dear Colleagues,

The Writ Petition filed by the BPEF Union in the Hon'ble High Court of Madras came up for hearing today. The Interim injunction granted to the trade union facilities of P3 NFPE Union and FNPO Union was opposed by our Advocate. The Government Advocate also presented the case of the Government side. On hearing the arguments of our Advocate, the Honourable Judge dismissed the WRIT PETITION filed by the BPEF Union and ordered immedieate restoration of trade union facilities to P3 Unions of NFPE and FNPO and also the IRM & ASRM Union which was cancelled based on the Interim Injunction granted by the Hon'ble Madras High Court recently.

In addition the Honourable Judge ordered that whole process of Re-verification has to be concluded within a period of three months - This means there is no stay to the ongoing process of Re-verification and the process will continue as usual.

FNPO hails this legal victory as the 'victory of the Postal Employees' who have always stood for honest trade unionism and opposed all types of machinations to scuttle the recognition of historic Federation and its Affiliated Unions and Associations. This legal victory should be a lesson to all forces who feel happy to see the trade union facilities temporarily withdrawn by the Administration on the face of Interim Injunction. Such types of joy aimed against our movement will only be short-liven as in the present case.

With this restoration of trade union facilitiy and the direction of the Honourable Court for completion of Re-verification process, FNPO calls upon all the Divisional and Branch Secretaries to complete the process of submission of Declaration Forms with 5 lists with their signature at the bottom of each page today itself - Remember today [26.04.2010] is the last day of submission to the Divisional Heads.

INDWF sources revealed that the proposal submitted by MOD on the approval of Fast Track Committee to create Four grade structure for industrial employees has been now approved by Ministry of Finance,(Department of Expenditure) on 22.04.2010.According to the approval the following proposal has been granted.

Central Civil Services (Conduct) Rules, 1974 - Submission of representations by Government servants - instructions regarding.


IMPORTANT GUIDELINES TO DIVISION SECRETARIES

1. Last date of receipt of declaration by Divisional Heads – 26-4-2010.
a). The list of members - five copies to be submitted.
b). Each page of members list to be Compulsory Signed by Division Secretaries

2. Display the list of members in the Notice Board – 27-4-2010 to 30-4-2010.

3. Representation from members if any before 6-5-2010.

4. Recovery of Subscription starts from 31-5-2010.

5. Completion of verification should be before 11-6-2010.

6. The Division Head should inform only the working strength of employees and not the Sanctioned strength, while sending report to the Circle Office, all the Division Secretaries Please ensure this.

7. If any Division Secretary submits fake and bogus authorization letters, he will be Penalized. Division Secretaries are requested to be careful in this respect.

8. Though the Department is against the dual membership, sister Union may play vital role in This regard and they may lure in getting signatures from our members. Therefore be careful In this respect.

9. If any malpractice is found in the process either on the part of Division Head or on the part Of the sister Union, please send email to subhashchander280@yahoo.com to the Directorate And a copy to tnrahate@yahoo.com and theagarajannachi@hotmail.com, if not possible, Please send telegram to the Director (SR), Dak Bhawan, New Delhi-110 001 and copy to CHQ and Federation.

10. Under any circumstances, don’t yield to the pressure of any one. The General Secretary NUPE Postmen & Group ‘D’ and President FNPO, Secretary General FNPO is always ready to help you in all aspects.

11. The CHQ and FNPO requests all Division Secretaries to rise to the occasion and try to Secure maximum percentage of membership to our affiliated Unions.

12. Don’t write P-IV, P-III, R-III, R-IV etc. on the authorization form. You have to write only the name of Union such as NUPE PM & Gr. ‘D’, NAPE ‘C’, NUR ‘C’, NUR IV, NUGDS and so on.

13. Divisional Secretary and Branch Secretary please mention Rs. 20/- as montly subscription of our nupepostmen and Gr D union on Authorisation form.

14. Divisional Secretaries should be present physically in the Headquarters on 26-4-2010 to Authorization forms to the Division Head, failing which it will be seriously viewed including Debarring membership.

15. You must be alert and tireless till 26-4-2010.

Re-verification of Membership Process is nearing completion and all the Membership Declaration/Authorisation Forms obtained from our members are to be submitted to the Divisional Heads on or before 26.04.2010.

All Divisional and Branch Secretaries are requested to complete the task and submit the Membership Declaration/Authorisation forms along with 5 copies of list of Members duly signed by the Divisional / Branch Secretaries / Authorised Office Bearers at the bottom of each page at the earliest before 26th April 2010.

No need to wait till the last hour - Submit all the collected Declarations / Authorization as early as possible, even one or two days well in advance - Any left out membership declaration forms can be collected and separately submitted up to 26th April.

be alert - be vigilant - be quick - complete the responsibility immediately - there is no change in re-verification schedule already announced by the department - ensure the status of nupe postmen & group ‘d’ union & FNPO affiliated unions.

Last date of submission of declaration to DIVISIONAL HEADS IS UPTO 26.04.2010

The declarations duly signed by the Divisional/Branch Secretary or any authorized office bearer must be submitted to the Divisional head (SSPOs/SPOs/SSRMOs). In case of members in the establishment of GPO's/HO's under independent charge of Chief Postmasters/Directors. The declarations should be forwarded to the Chief Postmaster/Director. The declarations must reach the Divisional Head on or before 26-04-2010. A list of declarations should be prepared in six copies—the declarations with five copies of the list should be submitted to the Divisional Head/Chief PM/Director as the case may be and one copy of the list should be retained by the Divisional/Branch Union. The list should be signed by the Divisional/Branch Secretary on each page. Care should be taken to educate the members not to give declaration in favour of any other Union. If any official signed more than one declaration to various Unions his declaration will not be taken into account and he will not be allowed to be the member of any Union till the period of next verification process whenever takes place.

The Divisional Head will scrutinise the authorisation (declaration) letters in presence of all authorized office bearer of the Union’s and display one copy of the each list on office notice board between 27-04-2010 to 30-04-2010. The Divisional/Branch Secretary should be careful to check the list of other Unions also to see if names of our members are included in any other Union's list.

In case the names of our members are found in any other Union's list, it should be seen that the concerned member gives a representation to the Divisional Head on or before 6-05-2010 clearly stating that he did not give any declaration (authorisation) in favour of that Union and that he has given his declaration (authorisation) letter only in favour of NUPE Postmen and Group ‘D’ Union and FNPO Affiliated Union.
