POSTAL DEPARTMENTAL COUNCIL JCM MEETING WAS HELD TODAY DATED 27-08-2010

(AFTER FOUR YEAR) The first meeting of the reconstituted Postal Departmental Council was held today [27.08.2010] at 11.00 Hrs in the Committee Room of Dak Bhawan. The Secretary Department of Posts who is the Chairman of the JCM Departmental Council chaired the meeting. The Official Side was represented by the Postal Board Member Technology and Member Personnel and several DDGs and Directors.

The Staff Side was represented by the Staff Side Leader, Staff Side Secretary, Secretary General NFPE and FNPO, and other Members of Departmental Council.

135 items were in the agenda. Nearly up to 70 items were discussed in the meeting within the duration of the meeting. It was decided to hold another meeting within a very short duration to complete the remaining 65 items.

I am directed to refer to Directorate letter No. 22.12/2001-GDS dated 17.09.2003 regarding observations of conditions of appointment of Gramin Dak Sevaks.

2. In para 4 of the said letter, it was stated that the sole criterion for selection to the posts of all categories of Gramin Dak Sevaks will henceforth be the merit subject to orders on reservation and fulfilling other eligibility conditions like providing space for Branch Office, taking up residence in the BO village etc.

3. The existing procedure does not provide for maintaining a select panel of candidates and operating a waiting list. In the event of selected candidate's refusal to take up the job, failure to provide accommodation within the given time ,etc the concerned recruiting authorities re-notify the vacancy and start the process afresh which oftenly results in delay and litigations.

4. The Hono`ble Central administrative Tribunal Hyderabad Bench an Original Application No.488/2007 filed by Shri M. Santosh vs Union of India .Replying on the Judgment of Full Bench of Hyderabad Bench in the case of M.Sarojini vs Senior Superintendent of Post Office,Vishakhapatnam in OA No. 1315/2000 dated 12.4.2001 wherein the Full Bench passed the order considering all these facts and circumstances we feel that the Department should prepare a panel even for selection to the posts of ED Agents under the P&T EDA(Conduct and Service) Rules,1964. The size of the panel shall not be disproportionate to number of posts. The validity of the period shall be one year."

5. The judgment of the Full Bench of Hyderabad CAT in OA No. 1315/2009 dated 12.04.2001 and the observations made by the Hon`ble High Court of Andhra Pradesh , the issue of regarding maintenance of a select panel and operating a waiting list for various categories of Gramin Dak Sevaks posts has been examined by the Competent Authority.

6. It has been decided that in all cases of future engagement of all categories Gramin Dak Sevaks including the cases which are currently in process and selections not finalized, a select panel of the candidates may be drawn up based on the sole criterion of merit. The panel should be operated in the event of the following contingencies:

(i) Refusal by the meritorious candidate.

(ii) Resignation by the 1st candidate even after joining within one year.

(ii) Review made by the higher authority within one year.

The select panel will be in the proportion of 5 candidates for one vacancy, ie 1.5. The Select Panel will be valid for one year from the date of finalization and after that it would lose its validity.

7. The contents of this letter may be brought to the notice of all authorities concerning to the recruitment of various categories of Gramin Dak Sevaks for strict compliance.

8. This issues with the approval of the Secretary (Posts).

Subject: Reservation in promotion - Treatment of SC/ST candidates promoted on their own merit.

The undersigned is directed to refer to this Department'sO.M.No.36028/17/2001-Est(Res) dated l1th July 2002 which clarified that SCI ST candidates appointed by promotion on their own merit and not owing to reservation or relaxation of qualifications will be adjusted against un-reserved points of the reservation roster and not against reserved points. It was subsequently clarified by this Department's O.M. No.3602811712001-Estt. (Res.) dated 31.1.2005 that the above referred O.M. took effect from 11.7.2002 and that concept of own merit did not apply to the promotions made by non-selection method.

2. Central Administration Tribunal, Madras Bench in O.A. No.900/2005 [S. Kalugasalamoorthy vs. Union of India & Others] has set aside the O.M. No.36028/17/2001-Estt. (Kes.) dated 31.1.2005 and held that when a person is selected on the basis of his own seniority. the scope of considering and counting him against quota reserved for SCs does not arise. The High Court of judicature at Madras in the matter of UOI vls. S. Kalugasalamoorthy [WP No.15926/2007] has upheld the decision of the Central Administrative Tribunal.

3. The matter has been examined in the light of the above referred judgments and it has been decided to withdraw O.M. No. 36028/17/2001- Estt. (Res.) dated 31.1.2005 referred to above. It is clarified that SCIST candidates appointed by promotion on their own merit and seniority and not owing to reservation or relaxation of qualifications will be adjusted against unreserved points of reservation roster. irrespective of the fact whether the promotion is made by selection method or non-selection method. These orders will take effect from 2.7.1997.the date on which post based reservation was introduced.

Income Tax Refund fortnight from August 16 to 31

The Income Tax Department will observe the second fortnight of August, 2010 as IT Refund period to solve the pending complaints of salaried tax payers up to the Assessment year 2008 – 2009. This IT Refund Fortnight will be observed all over Tamil Nadu from 16th August, 2010 to 31st August, 2010.

IT officers will sit with the complainants and solve the problem. There are about 2200 complaints are pending with IT department related with the refund of excess tax they paid or deducted from their income.

The salaried employees those refunds are pending should bring the original TDS certificate, Form 16, PAN card, TAN number, bank account details and current postal address etc., with them. You can view your status by log in to tin.nsdl.com

Sir/Madam,

I am directed to intimate that the staff side has taken up the above item in the Departmental Council (JCM) for discussion as agenda. The staff side has alleged that HRA has not been paid to the officials who are working against such vacancies resulting loss in emoluments and requested for issuing instructions to the Circles.

2. The attention of the Circle is drawn to Directorate letter no. 24-3/76-PAP dated 22.09.77 wherein it was decided for payment of compensation in lieu of rent free accommodation to Government servants for a maximum period of 3 months when he is posted of officiate in a post to which rent free accommodation is attached but which is not provided to him.

3. Further, attention is drawn Directorate letter no. 24-3/76-PAP dated 20.08.79 wherein instructions were issued for payment of House Rent Allowance as admissible to all Government servants not entitled to rent free accommodation for a maximum period of 90 days provided the vacancies are short term ones involving local arrangements. These instructions have not undergone any change and continue to apply.

4. It is, therefore, requested to reiterate these instructions of Directorate letter no. 24-3/76 dated 20.08.79 (copy enclosed) to all the subordinate units for grant of HRA to the Government servants who are officiating as Sub-Postmasters where rent free accommodation is attached and not provided to him and to avoid any grievances from the staffing the regard.

Opening of “Zero deposit/Zero Balance” accounts for workers employed under NREG Act, under PO Savings A/C Rules---Hon. MOS replied in Lok sabha

The rate of interest payable in Monthly Income Scheme (MIS) accounts in post offices is 8 per cent per annum and Bonus at the rate of 5 per cent is also payable on the deposits made under this scheme on or after 8th December, 2007 upon maturity of the deposit.

The interest rates on small savings schemes are regulated/reviewed as per recommendations of Committee on Administered Interest Rates and other related issues chaired by Dr. Y.V.Reddy, the then Deputy Governor, Reserve Bank of India(RBI) , according to which, being administered interest rates, they are benchmarked to average annual yield on Government Securities of comparable maturity in the secondary market, with a suitable spread subject to a maximum of 50 basis point over the benchmark yield, depending upon the maturity and liquidity of the instruments.

Bonus at the rate of 5 percent of the amount deposited in MIS accounts is payable in the accounts opened on or after 8th December, 2007 upon maturity of the deposit.

The Central and State Governments take various measures from time to time to promote and popularize small saving schemes through print and electronic media as well as holding seminars, meetings and providing training to various agencies involved in mobilizing deposits under the schemes.

As part of this ongoing exercise, Government has taken following steps to make the small savings schemes more attractive and investor friendly:-

The benefit of Section 80C of the Income Tax Act, 1961 has been extended to the investments made under 5-Year Post Office Time Deposits Account and Senior Citizens Savings Scheme, with effect from 01.04.2007.

With effect from 1.8.2007, the maximum deposit ceilings of Rs.3.00 lakh and Rs.6.00 lakh under the Post Office Monthly Income Account (POMIA) Scheme has been raised to Rs.4.50 lakh and Rs.9.00 lakh in respect of single and joint accounts respectively.

The penalty on pre-mature withdrawal of deposits under the Post Office Monthly Income Account (POMIA) scheme has been rationalized from 3.5% to 2% on withdrawal on or before expiry of three years and 1% on withdrawal after expiry of three years.

All categories of pensioners have been allowed to open and maintain ‘Pension Account’ under Post Office Savings Account Rules, with effect from 11th July, 2007.

The restriction on opening of more than one account during a calendar month under the Senior Citizens Savings Scheme has been removed with effect from 24th May, 2007.

Opening of “Zero deposit/Zero Balance” accounts for workers employed under NREG Act, under Post Office Savings Account Rules, with effect from 26th August 2008.

Opening of “Zero deposit/Zero Balance” accounts for Old Age Pensioner Account under Indira Gandhi Old Age Pension Scheme, Widows Pensioner Account under Indira Gandhi National Widow Pension Scheme and Disabled Pensioner Account under Indira Gandhi National Disabled Pension Scheme with effect from 13th October 2009.

National Savings Institute, a subordinate organization under the Department of Economic Affairs (Budget Division) also maintains its web site i.e nsiindia.gov.in in collaboration with National Informatics Centre to facilitate interface with the public through wider dissemination of information on small savings and on-line registration and settlement of investor’s grievances.

The undersigned is directed to refer to this Department's O.M. No.35034/3/2008-Estt(D) the 19th May,2009 regarding introduction of Modified Assured Career Progression Scheme (MACPS) for the Central Government Civilian Employees and to say that para 13 of Annexure-I of the Scheme provides that Existing time bound promotion scheme including in-situ promotion scheme. Staff Car Driver Scheme or any other kind of promotion scheme existing for a particular category of employees in a Ministry/Department or its offices, may continue to be operational for the concerned category of employees if it is decided by the concerned administrative authorities to retain such Scheme, after necessary consultations or they may switch over to the MACPS. However, these Schemes shall not run concurrently with the MACPS.

2. In pursuance of the decision taken in the meeting of the Departmental Council (JCM) of Department of Personnel & Training held on 08.05.2010 in respect Agenda Item No.57.31, it has been decided in consultation with the Department of Expenditure, the benefit of the MACPS shall also be extended to the regular Staff Car Drivers of the Central Government Ministries/Departments/Offices, as a fall back option, if they are unable to get promotion within the percentage based present system.

3 Para 13 of the Annexure-I of the MACPS accordingly stands modified to this effect. In other words, the Staff Car Driver Scheme and the MACPS shall run concurrently.

4. All Ministries/Departments may give wide circulation to this decision for general guidance and appropriate action in the matter.

Subject: Disbursement of salary /wages to the Central Government Employees in the State of Kerala for the month of August, 2010 on account of ONAM festival.

In view of the "ONAM" festival the Government have decided that the salary of all Central Government Employees in the State of Kerala for the month of August, 2010 may be drawn and disbursed in the Central Government Offices (including Defence, Posts &Telecommunications) on 20th August, 2010.

2. The wages for August, 2010 of the individual employees of Central Government serving in the State of Kerala may also be disbursed in advance on 20th August, 2010.

3. The salary /wages so disbursed are to be treated as advance payment and will be subject to adjustment after the full months salary/wages of each employee is determined. The adjustment, if any, will be made without exception from the salary /wages as the case may be from the month of September, 2010.

4. The concerned Ministry/Departments are requested to bring these instructions to the notice of their offices located in the State of Kerala for necessary action immediately.

I am directed to intimate that One-man Committee constituted under Shri. R.S. Nataraja Murti Chairman examined the issue of deployment of Gramin Dak sevak Mailmen posted in Mail Offices by conducting a study and submitted its recommendation in para 5.22 of the Report.

2 The recommendations of One-man Committee on GDS Mailmen have examined by the department and after a careful consideration, the Competent Authority ordered the following.

1) Conducting of a work study by Internal Work Study Unit (IWSU) for laying down the standard for various operations/ work done by Mailmen in Mail Offices/Transit Mail Offices/Mail Agency.

2) The existing vacancies of GDS Mailmen and future resultant vacancies of GDS Mailmen failing vacant either due to discharge/ absorption in Department shall not be filled up in future.

3) The category of GDS Mailmen be considered as a wasting group.

4) The present GDS Mailmen engaged in Mail offices on regular basis shall continue till they vacate the post either due to discharge/absorption in department or death.

3. The instruction may be brought to the notice of all concerned. The compliance may sent in the prescribed enclosed proforma .

We have heard learned counsel for the parties.
During the course of hearing of this batch of
Appeals, the appellants represented by the Director
(Staff), Ministry of Communication & I.T., Department of
Posts filed an additional affidavit which may put an end to

The controversy between the parties. In fact, the said additional affidavit has been filed pursuant to certain observations made by this Court while hearing the appeals.
It is evident from the affidavit that the entire matter was reconsidered by the Department and upon such reexamination based on humanitarian considerations, found that out of 204 respondents in all 202 respondents working in the Department against short term/leave vacancies can be accommodated against compassionate appointment vacancies for the years 2000-01 to 2009 as per the departmental guidelines. However, in the case of Postal Assistants (PA)and Sorting Assistants (SA) cadre, according to the Ministry, the number of vacancies is not enough to accommodate all of them in the cadre. It is stated that the number of vacancies earmarked for this period is only 113 whereas the number of respondents claiming the relief is 152. However, it is stated that as a one time measure, the Department is willing to accommodate them against residual vacancies of the Department. The statement made in the affidavit is made part of the record directing the respondents to act upon the same.
In the circumstances, the appellants are directed to regularize the services of all the 202 respondents who are working in the Department against short term/leave
Vacancies with effect from their date of appointment.
However, the respondents shall not be entitled for payment of any arrears on account of such regularization. But their pay and pensionary benefits are protected.
In view of this order, it is made clear that the findings recorded by the Tribunal and as well as the High Court with regard to the interpretation of office memorandums and circulars of the Department are set aside and those findings and observations shall not be treated as precedent for the purpose of any other case or cases that may be pending. The questions of law, if any, are left open.
The appeals are accordingly disposed of without any order as to costs. The interlocutory applications are accordingly allowed.
