7th CPC Latest News: E-CoS may table its report on higher allowances before Cabinet on June 1; no decision on arrears

 If media reports are to be believed, the Empowered Committee of Secretaries (E-CoS) is likely table its report on higher allowances under the 7th Pay Commission before the Union cabinet on June 1.

New Delhi, May 30: Central government employees, who have been waiting for higher allowances under the 7th Pay Commission since July last year, may receive some good news on June 1. If media reports are to be believed, the Empowered Committee of Secretaries (E-CoS) is likely table its report on higher allowances under the 7th Pay Commission before the Union cabinet on June 1. The Empowered Committee is in last stages of finalising draft on Committee on Allowances’ report on higher allowances, including house rent allowance (HRA), under the 7th Pay Commission. However, there is no clarity whether the government will agree to pay arrears on higher allowances.

The Empowered Committee of Secretaries (E-CoS) is likely to meet the Union Finance Minister Arun Jaitley on June 1, where they would submit their recommendations about Committee on Allowances’ report on higher allowances under the 7th Pay Commission. National Joint Council Chief Shiv Gopal Mishra had been given assurance by the Cabinet Secretary P K Sinha who heads the E-CoS that all demands demands of the central government employees would be considered.

On June 1, the Empowered Committee of Secretaries (E-CoS) will hold a key meet in which the final draft on higher allowances and HRA under the 7th Pay Commission will be discussed along with other proposals and demands. However, the NJCA convenor is not sure whether their demands about arrears on higher allowances under the 7th Pay Commission will be accepted by the E-CoS. Earlier, a Sen Times report said the E-CoS may stick to the recommendations of the 7th Pay Commission on higher allowances.

The 7th Pay Commission, led by Justice (retd) A K Mathur, suggested the abolition of 52 out of the 196 existing allowances, apart from subsuming 36 smaller allowances. The decision was widely opposed by the central government employees, after which Arun Jaitley had formed the Committee on Allowances to look into anomalies. The Committee on Allowances, which examined the 7th Pay Commission recommendations on allowances, submitted its report to the finance ministry on April 27.

“We trawl the web and harvest data that is available publicly on social media platforms, websites and blogs,” he added. The firm has so far raised $15 million in two rounds from Matrix and Sequoia.
“We don’t have plans to raise more funds at this point. We are planning to increase the employee base from 80 to 140,” he said.
Cheaper, easier
He said top IT companies, including multinational firms, pay up to 30 per cent as fee on each candidate. For top slots, they are supposed to look at hundreds of profiles.
Typically, this kind of recruiting happens for mid-level positions, Sharma said. But how reliable is a person’s online persona? Can’t it be faked?

Labour Code on Wages to be sent to cabinet for approval: Labour & Employment Minister 3.87 crore candidates & 14.8 lakh establishments registered on National Career Service Portal 
The Minister of State for Labour & Employment (IC), Shri Bandaru Dattatreya has announced that the 40 crore workers from unorganized sector will be covered under social security schemes such as ESIC & EPFO. The Minister said that the Government is committed to ensure wage, jobs and social security for all workers including unorganized sector. Shri Dattatreya was addressing a function on the 3 years achievements of the his ministry in New Delhi today. He said that the Ministry is implementing reforms and new ways and means for employment generation. India is the only country which has launched Shram Suvidha Portal for effective compliance and ease of doing business. The Ministry is implementing the National Career Service (NCS) project as a vibrant platform for transforming and strengthening the public employment services in the country.
Shri Dattatreya said that the Ministry got the following Acts passed by the Parliament during last 3 years.
1- The Child Labour (Prohibition and Regulation) Amendment Act, 2016 which ensures complete prohibition on employment of children below 14 years and also prohibited the adolescents (14-18 years ) to work in hazardous occupation/processes
2- The Maternity Benefit (Amendment) Act, 2017 under which maternity benefit to woman has been increased from 12 weeks to 26 weeks for two surviving children and 12 weeks for more than two children
3- The Payment of Wages(Amendment) Act,2017 enables the employers to pay the wages to their employees by cash or cheque or crediting it to their bank account.
4- The Employees’ Compensation (Amendment) Act, 2017 has the provision to increase the penalty for contravention of Act from present Rs.5000/- to Rs. 50,000/- extendable to Rs.1 Lakh.
5- Payment of Bonus Amendment Act, 2015 has enhanced the eligibility limit under section 2(13) from Rs. 10,000/- to Rs.21,000/- per month.
6- The Industrial Employment (Standing Orders) Act, 1946 has been amended by notification to include “fixed term employment” for textile (apparel) sector as a part of textile package to enhance employment.
The Labour & Employment Minister said that the Ministry is working on the proposed codification of existing Labour Laws into 4 Labour Codes.
(i) Labour Code on Wages

(iii) Labour Code on Social Security and Welfare
(iv) Labour Code on Occupational Safety and Working Conditions
The Group of Ministers has approved the Labour Code on Wages and it will be sent to cabinet for approval.
The Minister said that the Minimum wage (per day) for non-agricultural worker in the ‘C’ area category increased from Rs.246/- to Rs.350/-, Rs437/- in ‘B’ Area category and Rs.523/- in ‘A’ area category. He also informed that the Shram Suvidha Portal is a single unified web portal for submissions of common Annual Return under 9 Central Acts and monthly common Electronic Challan Cum Return (ECR) for EPFO and ESIC. He also informed that Unique Labour Identification Number (LIN) is allotted to Units and 19,23,162 Lakhs LIN allotted as on on 22nd May, 2017. Total 2,95,423 inspections have been assigned and out of that 2,76,931 inspections have been uploaded as on 22nd May, 2017. Common registration under EPFO and ESIC has been facilitated on the Shram Suvidha Portal since 30th April, 2017
Shri Dattatreya said that Registers/Forms to be maintained under various labour laws are simplified. 56 Registers/- Forms under 9 Central Labour Laws and Rules made thereunder have been replaced with 5 common Registers/Forms. The notification has been issued on 28th March, 2017 for reducing Forms under certain Labour Law Rules from 36 to 12. It is applicable to the establishments under the jurisdiction of Central as well as State Governments.
He said that employers can apply for EPF code number online by uploading of digitally signed documents. As on 06th December, 2016 around 1.52 Lakhs establishments have been obtained online registration on OLRE portal. Universal Account Number(UAN) has been made compulsory and online credit system introduced. Minimum pension under Employees’ Pension Scheme, 1995 has been revised to Rs. 1000/- in perpetuity per month w.e.f. April 2015. Time limit for claim settlement has been reduced to 10 days from 20 days. No documents required and only self-certification is necessary for withdrawal under the EPF scheme for the accounts linked with Aadhaar.
The Minister informed that ESIC is now covering complete districts instead of targeted industrial clusters. Coverage expanded to all 393 districts where these clusters are located. 301 districts have been fully covered. In the second phase, the target is to cover all the remaining districts of the country. “One IP-Two Dispensaries” scheme has been launched for the benefit of migrant workers. Now Insured Persons can choose two dispensaries, one for self and another for family through an employer.
Shri Bandaru Dattatreya said that over 3.87 crore candidates, 14.8 lakh establishments are registered on the National Career Service (NCS) Portal and it has mobilized over 6 lakh vacancies. Around 540 job fair were organised in 2016-17. The NCS project also involves setting up of 100 Model Career Centre to deliver quality employment services and these centres are being set up in collaboration with States and Institutions. NCS has partnered with Department of Posts and common services centre to extend registration of job seekers through the Post Offices.
Pradhan Mantri Rojgar Protsahan Yojana (PMRPY) scheme has been announced to incentivize employers for new employment. Government will be paying the 8.33% EPS contribution for these new employment for the period of 3 years. For the textile (Apparel & made up) sector, Government will also pay the 3.67% EPF contribution of employers for these new employees. Till now benefit have been transferred to 1,954 establishments covering 75,848 beneficiaries under the scheme with an expenditure of Rs. 6 crores (approx.).
Rehabilitation of Bonded Labour Scheme has been revised with effect from 17th May, 2016 where financial assistance has been increased from Rs.20,000/- Rs.1,00,000/- per adult male beneficiary, Rs 2 Lakh for special category beneficiaries such as children including orphans or those rescued from organized & forced begging rings or other forms of forced child labour and women. Rs 3 Lakh in cases of bonded or forced labour involving extreme cases of deprivation or marginalization.
The Secretary, Ministry of Labour & Employment, Ms. M. Sathiyavathy in her welcoming address said that the Government is creating environment to facilitate employment with quality and fair wages. For this number of initiatives and programmes have been undertaken.On this occasion, Shri Dattatreya inaugurated Centre of Excellence (Ophthalmology) of ESI PGIMSR & Model Hospital and Physiotherapy & X-ray units of ESIC on PPP model for beneficiaries for Delhi region. He also inaugurated EPFO Regional Office, Delhi (West) and Regional Office, Delhi (Central). The Minister Felicitated six model employers and also released a book on 3 years’ achievements and initiatives of the Ministry of Labour & Employment.

Important Documents on Gandhi’s Assassination Missing from Official Records, Reveals RTI

Nathuram Godse’s execution order and knowledge of the whereabouts of three of the accused are some of the documents missing from the national archives.

Upon examining the files – contained in 25 CDs in the National Archives of India (NAI) – on Mahatma Gandhi’s assassination and the trial of the accused, the Central Information Commission (CIC) has concluded that “there is no comprehensive record of Gandhi files compiled at one place on assassination of Gandhi”. With the records also revealing that three of the accused had absconded and were never traced, Information Commissioner Sridhar Acharyula has directed the Prime Minister’s Office (PMO) and Ministry of Home Affairs to get involved in consolidating all the records on the case.
The CIC has also observed that while important questions persist regarding “whether copy of final charge-sheet in Gandhi murder and order of execution of accused number one, Nathuram V. Godse case are missing from the record” and, if so, what action was taken to trace them, the fact remains that there was “no response to the question about apprehension of missing of two important records”. It further stated that National Archives of India too does not hold all the files on Gandhi’s assassination “and they cannot say anything about it as they are merely recipients of records given by others”.
The detailed order is a response to an application filed by Hemanta Panda. He inquired into the records on Gandhi’s assassination by claiming to be a researcher interested in the topic and sought a copy of the FIR registered at Tughlaq Road police station in Delhi, a copy of the final chargesheet in the case and a copy of the order to execute the accused, Nathuram Godse. Acharyulu delved into the research conducted on Gandhi’s assassination and also cited several relevant papers in his response to Panda’s query.
The Information Commissioner noted that the CPIO of the Ministry of Culture, Jayaprabha Ravindran, had submitted that the appellant was allowed to inspect the files at NAI, and was also provided a copy of the charge sheet and FIR. Panda was also provided certified copies of the case documents he needed. But, “he complained that he could not find two important documents, final charge sheet issued by the Delhi Police and order of execution of Nathuram Godse.”
In his order, Acharyulu said, the appellant stated that the record showed that three persons accused of Gandhi’s assassination – Gangadhar Dahawate, Surya Dev Sharma and Gangadhar Yadav –  were absconding, but there was nothing to show whether any efforts were made to apprehend them or if the criminal case against them was closed.
Acharyulu said the Tughlaq Road police station had stated that it had deposited the original FIR with the NAI. Ravindran also stated that as the NAI has been under heavy pressure because of RTI requests related to Gandhi, Subhash Chandra Bose and Vallabh Bhai Patel, it has digitised most of its records. She said the records pertaining to the accession of 600 princely states to India under Patel, and the records related to Bose have been made available in their digitised form and are now also accessible in the National Virtual Library Institute and National Science Centre.
Acharyulu also noted that deputy director of NAI, Sanjay Garg, had explained to the commission that when the capital of India was shifted from Calcutta (now Kolkata) to New Delhi in 1911, the Imperial Records Department (IRD) was also shifted to its present building in 1926.
Acharyulu, who also visited the section dedicated exclusively to Gandhi by the NAI – where all the documents and books relating to the leader are placed – said the place has more than 11,000 pages of information on Gandhi’s murder trial records, with everything from the FIR registered at Tughlack Road to the final judgment in the East Punjab high court at Shimla. “As the records are old enough, difficult to be handled, the NAI has rightly digitised it and made accessible in CD form,” he said.
Noting that there were 12 people accused in the case, namely Nathuram V. Godse, Narayan D. Apte, Vishnu R. Karkare, Madanlal K. Pahwa, Shankar Kistayya, Gopal V. Godse, Vinayak D. Savarkar, Dattatraya S. Parchure, Gangadhar S. Dandawate, Gangadhar Jadhav, Suryadeo Sharma and Digamber R. Badge (who had turned approver), the Information Commissioner said the records pertaining to the charge-sheet show that three accused were absconding but the NAI cannot give any opinion or information about why they were not arrested.
Stating that the appellant had demanded a copy of the ‘final chargesheet’, Acharyulu said the “the records did not show any thing like primary or final, but there is one chargesheet and documents containing framing of charges by the court, which are inspected by the appellant. NAI did not possess any of the jail records hence they could not provide a copy of order of execution of Nathuram Godse and another accused.”
Piecing together the complete record
The CIC also noted that since a three-judge bench had analysed Savarkar and Godse’s strong views on Gandhi’s policies as a particular opinion on the historical events of the age – which could be expressed without any restriction – the bench had dismissed the possibility of rejecting the copy of Godse’s statement on the grounds of section 8(1)(a).
Referring to various writings that raised several doubts about Gandhi’s assassination and the events surrounding it, Acharyulu said “people have right to information to clear the above doubts.”
He also said the prime minister declassified 100 secret files pertaining to Bose in January 2016 and promised to release 25 declassified files every month. “This is a significant step towards transparency about the history of national heroes. Similarly, the prime minister needs to place the official documents, declassifying them if necessary, regarding Gandhi. There are huge repositories of books and papers on Gandhi’s life by private and public authorities. Unfortunately, there is no official compilation record at one place about his death,” he said, adding that the PMO should be forwarded the RTI “for their information and necessary action to formulate appropriate policy to build archives of records regarding Mahatma Gandhi’s assassination, investigation, trial, punishment, official correspondence, and action taken on the recommendations of JL Kapur Commission”. The commission was appointed by the government to inquire into the conspiracy angle and other aspects of Gandhi’s assassination.
Observing that a copy of the Justice Kapur Commission’s report was available with the Indian Law Institute in New Delhi, he said there was is also a need to build an archive around the subject at the NAI. Acharyulu also suggested that the CPIO should forward the RTI to the MHA so that it can trace the entire record of the Kapur commission’s hearings and depositions, documents and notes on the case.
Likewise, the Information Commission noted that the RTI should be forwarded to the SHO Tughlaq Road for case diaries or any other records on the investigation, including efforts to trace the three absconding accused (if any of the accused were absconding) in the Gandhi assassination case; the Registrar General of Supreme Court of India, for any judicial record on the assassination case; and the Secretary General of Parliament of India, for the complete record of the Kapur Commission’s findings, including the original report on the conspiracy to assassinate Gandhi.

7th Pay Commission: Lavasa committee takes positive view on allowances, HRA

The meeting on allowances as per the 7th Pay Commission will be held on June between the Empowered Committee of Secretarites (E-CoS) and Arun Jaitley. With central government employees waiting for a key update on allowances, sources say that the Ashok Lavasa committee has taken a favourable view on sticking points such as House Rent Allowance and other allowances.
The central government employees have been complaining about an inordinate delay on an announcement regarding allowances. However government sources say that the process would speed up following the meeting with Finance Minister, Arun Jaitley on June.

The Ashok Lavasa committee has taken a favourable view on sticking points such as House Rent Allowance. The 7th Pay Commission had given its recommendation of reducing the HRA for Central Government employees, depending upon the type of cities they live in. For those living in metro cities, the Pay Panel suggested bringing down the HRA from 30 per cent to 24 per cent. it also suggested reducing the HRA for Central Government employees living in villages.

Most demands will be accepted

During a meeting of the National Joint Council Chief Shiv Gopal Mishra and the Cabinet Secretary it was informed that the demands would be reviewed. Mishra was informed that all the demands would be reviewed. An assurance that all the demands would be accepted was also made.

On arrears

The NJCA has raised doubts on whether the demands on arrears on higher allowances will be accepted by the government. There would be further discussions on this. Sources indicate that the central government employees may have to wait a few weeks more for a proper update on the same.

After the meeting the Cabinet Secretary, P K Sinha assured that the Empowered Committee of Secretaries (E-CoS) will go through the Ashok Lavasa report. The NJCA chief also gave a letter on inordinate delay in implementation of the report of the Ashok Lavasa-led Committee on

The NJCA chief and several other expressed their anguish over various pending demands such as minimum wages and revision of fitment formula. The Committee on Allowance headed by Finance Secretary Ashok Lavasa had submitted its review report to Arun Jaitley last month.

What next on 7th Pay Commission allowances

The 7th Pay Commission was constituted in 2014 and it was implemented in June 2016. The Cabinet Secretary has said that he has fixed June 1, 2017, for the perusal of the report of the Allowances Committee by the ECoS. Soon after a memorandum will be sent to the Cabinet for consideration. After the Ashok Lavasa committee submitted its report on an allowance, the ECoS is expected to hold a discussion to look into the demands on arrears and allowances and a demand of increase in minimum wage.

BSNL plans satellite phone service for all in 2 years

NEW DELHI: State-run BSNL is planning to extend satellite phone services for all citizens in two years that can work at any corner of the country and remain immune to breakdown of mobile services during natural calamities.

"We have applied to International Maritime Organisation. It will take some time to complete the process. In 18-24 months, we will be in a position to open satellite phones service for citizens in a phased manner," BSNL chairman and managing director Anupam Shrivastava told PTI.

Satellite phones will able to work in any part of the country, even inside flights and ships, as they depend on signals directly from satellites located about 35,700 kms above the earth.

Traditional mobile networks cover around 25-30 kms around towers and can transmit signals to phones placed equal to or below the height of the tower.

BSNL has started satellite phone service using INMARSAT service which will be initially offered to government agencies and later extended to citizens in a phased manner.

The service will cover areas where no networks are present and be provided by INMARSAT which has 14 satellites.

Agencies handling disasters, state police, railways, Border Security Force and other government agencies will be given the phones in the first phase.

"The number of satellite phone connections in India is very little but once we open it for citizens, the whole dynamics in the market will change. The volumes will bring down the cost of service. We are charging only Re 1 over the cost that satellite firm will bill to us," Shrivastava said.

Call rates on satellite phones are expected to be in the range of Rs 30-35 in the first phase when there are only about 4,600 connections in the country.

"Satellite phones also cost Rs 40,000 and more. All the satellite phones are imported at present. Once we open it for citizens, the volumes will drive down the cost of calls as well as handset. Even, huge volume can attract satellite phone manufacturers to set-up their unit in India. We expect it to create a new ecosystem of satellite services in the country," Shrivastava said.

Satellite phones in India are presently provided by Tata Communications, which inherited the licence from Videsh Sanchar Nigam Limited (now Tata Communications Ltd).

The services of TCL will be phased out by June 30, 2017 and all the connections will be transferred to BSNL.

There are 1,532 authorised satellite phone connections that can operate within the country and a majority of them are used by security forces. TCL has also issued 4,143 permits to maritime community for use of such phones at ships.

There have been security concerns on use of satellite phones in India.

Telecom regulator Trai has said there is a possibility that communication through such phones can be monitored by foreign agencies as their gateways are located outside India, it added.

Cognizant layoff plea closed in favor of sacked staff: Govt

The Cognizant layoff case has been closed in favour of employees and the company has been asked to hold talks one—on—one to resolve the issue.
“We have closed the case in favour of affected employees and suggested the company management to continue everybody and hold one—on—one discussion to resolve the issue,” Telangana Joint Labour Commissioner Chandra Shekaram told PTI over phone from Hyderabad on Saturday.
As many as eight employees had filed petition with the labour department, complaining against Cognizant for forced resignation as the company went ahead with a performance—based human resource review.
“Yesterday [Friday], a team from Cognizant met the joint commissioner of labour in Hyderabad,” the Cognizant spokesperson said. “We reiterated that allegations about employees being forced to resign are totally unfounded.
Cognizant has not conducted any layoffs and changes resulting from the company’s performance review process are consistent with the standard practice that has been followed by the IT industry for many years.”
The labour department has also advised the company management to give one more opportunity for the petitioners to prove themselves, Shekaram said.
“We have also advised the management to give all eight employees one more opportunity to prove their mettle,” he added.
The labour department also has advised employees not to resign, Shekaram said.
“We have advised the employees not to tender resignation because once they did that they would lose their right to petition us or move labour courts. A sacked employee has all the right to contest his termination,” he argued.
Out of the eight petitioners, three had resigned and “we have asked them to withdraw their resignations” for contention.
“The company has also accepted considering revoking resignations of the three employees and engaging them in discussions,” he added.
The company has not been given any timeline to resolve the matter.
FITE, a representative body of employees working with IT companies and call centres, had alleged that the US—based firm is illegally terminating thousands of employees by forcing them to resign. It held that highly—paid experienced professionals are being replaced by those with lesser experience and lower pay.
To a query, Shekaram said that if the employees are still unhappy with the outcome of the discussions, they can revert to the labour department or move the labour court.
“If they revert to us, we will try to deal the case within the parameters of the Industrial Disputes Act and take stern action. If the company has been found violating, we will punish them,” he said.
“Generally, it is not easy to terminate an employee,” he warned.
Under fire for its ‘employee separation package’, Cognizant President Rajeev Mehta had said the company has not made any layoffs, but conducted performance reviews to reflect on the work of last year and ensure the goals for the subsequent year are clear.
He also contended that the software player had offered the employee separation package in India and the US for the first time, unlike its peers, who keep taking such steps regularly.
It has rolled out a ‘voluntary separation programme’ for directors, associate vice—presidents and senior V—Ps, offering them 6—9 months of salary to make way for the new generation to move up the chain.

Migration to 5G will be challenging for India: Experts

NEW DELHI: Aligning with the global markets for 5G technology will be a journey full of roadblocks for India, industry stakeholders and experts said and pointed out that backhaul will be a major challenge in the migration from existing networks to 5G with less than 20 per cent Indian networks running via fibre optic cables.”One of the fundamental requirements for 5G is strong backhaul, which is simply not there and that is the most time consuming part and it is extremely expensive in today’s condition in India,” Jalaj Choudhri, EVP, Reliance Communications said.Backhaul is a network that connects cells sites to central exchange. Even if India is able to circumvent the challenges of standardisation and 5G truly becomes available by 2020, yet a good 5G network cannot be expected unless we have a reliable and strong backhaul.In India, 80% of cell sites are connected through microwave backhaul, while under 20% sites are connected through fibre. Analysts say microwave backhaul has bandwidth issue since it uses traditional bands providing 300 Mbps of capacity, whereas fiber-based backhaul can offer unlimited capacity and low latency, a perquisite for 5G applications.”Fibre infrastructure has to be considered civic infrastructure rather than a property of the service provider. The investment has to be made through civic bodies so that service providers can actually leverage that infrastructure,” said Choudhri.Chinese telecom gear maker Huawei’s director, marketing and integrated solutions, Chandan Kumar, said that besides identifying a new spectrum for the Indian market and harmonising it with the global spectrum strategy, there is a need for a robust backhaul network.”We advocate that robust backhaul network is a must for 5G adoption. Otherwise, we will be ready technology-wise and spectrum-wise, but if our backhaul is not flexible and sufficiently available, that could be a bottleneck for 5G adoption,” Kumar said.Larry Paulson, President, Qualcomm India, said telecom operators here will need to make a business case judgement on what are the leading applications for 5G.Experts believe 5G technology will be a gateway of sorts for a truly connected society. It is slated to power a host of new-age services such as machine-to-machine (M2M) communications, Internet of Things (IoT), connected smart cities, self-driving cars, remote control surgery to virtual reality.Likewise, a 5G-powered IoT environment could enable someone to connect his home to a wireless network by embedding it with electronics, software or sensor technology. A typical example could be a remote operation of a house’s security system.”Under 20% of total towers are fiberised in India, while global benchmarks are much higher. Fiberisation of towers will be key to increasing backhaul capacity.Furthermore, installation of higher capacity microwave links where fibre laying is problematic also a solution,” said Rohan Dhamija, head for India and South Asia at Analysys Mason.The commercial launch of 5G technology is likely to take place around 2019-2020 globally. In India, field, content and application trials will start around 2018.
