Maharashtra Circle IMPORTANT ANNOUNCEMENTS- Direct Recruitment Examination for Postman/Mailguard and MTS examin the year 2015 -1st of non-tainted candidates.

 Maharashtra Postal Circle conducted examination for direct recruitment ofthe Cadre of Postman-Mail guard to fill up the vacancies of 1680 Postman and 2lMail guards for the year 2012,2013 & 2014 and for 733 vacancies of MTS for thcyear 2009 to 2014. Accordingly examination was conducted on 29.03.2015 for'Postman & MTS and 03.05.2015 for MTS cadre and final result was declarcd aswell as published on departmental website on 29.03.2016.

 

2. As certain discrepancies were noticed in the examination process, (lirclcOffice issued order dated 10.06.2016 to stay all activities pursuant to therecruitment examination of Postman/Mail Guard and MTS till further ot'det's.Candidature of candidates whose documents verification was under process washeld up.

 

3. In pursuance of Inquiry Report of APMG(Vigilance) dated 10.11.2016, it rn,asdecided that "the result of examination for the direct recruitment of

Postman/Mailguard hetd on 29.03.2015 and another exam for MTS held on03.05.2015 in pursuance of notifications issued vide Maharashtra Circle Memo No.Recttl2'SlPostman-Mc/DR/2014 dated 24.01.2015 and No. Recttl2'8lMTS/DR/2014dated 24.01.2015 stands cancelled w.e.f. 25.11.2016. Fresh examination will beconducted for Postman/Mail Guard and MTS in Maharashtra Circle for dcclaledvacancies." Accordingly, services of candidates who had already joined thcdepartment were terminated under sub rule (1) of Rule 5 of the Central CivilServices (Temporary Service) Rules 1965, with payment of one month salary in lieuof the notice period.

 

4. The Hon'ble High Court of Judicature at Bombay Bench at Arrrangabad inWP No.l2ll7 of 2016 & 7 others, pronounced the.Iudgmcnt ordel on 03.Oir,2019and passed the following orderl-i. The order of cancellation of entire examination is set aside to the extent ofthe petitioners herein.ii. The respondents are directed to verify again, whethr:r there arc an]'suspicious circumstances and irregularities in case of the petitionelsherein and if no such suspicious circumstances, irregularities ormalpractices are found as discussed in the judgement, the selection of thepetitioners be restored and further process shall be completed within aperiod of two months.iii. As far as the petitioners in Writ Petition No. 9910 of 2077 are concerncd.the respondents shall verify their record as well and if no suspiciouscircumstances or malpractices as discussed in the judgemcnt arc noted intheir individual cases, their appointment shall be restored within a pcliodof two months with 50% back wages.

 

5. Hon'ble Supreme Court in Order dated 03.12.2020, upheld impugned order(s)of Hon'ble High Court of Judicature at Bombay Bench at Aurangabad anddismissed the Special Leave Petitions filed by the Department.

 

6. For uniformity to all the selected candidates, it is decided to implement t.hcrJudgment for all the candidates irrespective of whether they have approached Courtor not.

 

7. In view of Judgment Order of Hon'ble Supreme Court and approval ofDirectorate for implementation of the Judgment, a Committee was constituted towork out strategy for segregation of the candidates as tainted and non-tarnted.**,

8. On the basis of recommendation of the Committee, approval of competentauthority is hereby conveyed to treat 1282 candidates in Postman/Mailguard cadlcand 592 candidates in MTS cadre as non-tainted. These candidates are consideredfor completion of further appointment formalities subject to fulfillment of prescribedconditions for appointment. Order regarding payment of 50% back wages to theeligible candidates in the above list will be issued separately.

9. The candidates are allotted to the same Division/office where they n,clr'allotted/posted earlier except candidates allotted to PSD Mumbai, I)SD Kolhapur'and RO Pune. These candidates are re-aliotted tb other I)ivisions/Ilnits as pet thcrevised list of allotment. The Divisionwise list of 1282 candidates inPostman/Mailguard cadre and 592 candidates in MTS cadre is attached. Con<;elnedDivisions are directed to take necessary action for appointment of these non-taintcdcandidates at the earliest.
