Subject Clarification on date of effect of DoPT OM No 36012/1/2020-Estt.(Res-II) dated 17.05.2022 – reg.
The undersigned is directed to refer to Railway Board O.M. No.E(NG)I/2023/PM4/6(E-3424124) dated 02.11.2023, OM No. 2017/ERB-6/3/2 dated 17.10.2023 and OM No. E(NG)I/2023/PM4/19(E-3448953) dated 11.12.2023, regarding clarification on date of effect of DoPT OM No. 36012/1/2020-Estt.(Res-II) dated 17.05.2022.

In this regard, it is stated that in pursuance of the Hon’ble Supreme Court judgement dated 30.6.2016 in Rajeev Kumar Gupta case, judgement dated 14.1.2020 in Siddaraju matter and the order of the Hon’ble Supreme Court dated 28.9.2021 in Siddaraju case, DoPT issued OM No. 36012/1/2020-Estt.(Res-II), dated 17.5.2022 extending the benefit of reservation in promotion to Persons with Disabilities (PwD). This OM was effective from 17.5.2022.
3. Further, in compliance of the order dated 18.7.2023 passed by the Hon’ble Supreme Court in S.S. Sundaram Contempt Petition (Civil) No. 873/2023, this Department issued an OM No.36012/1/2020-Estt(Res-II), dated 28.12.2023 extending the benefit of reservation in promotion to the eligible PwD candidates on notional basis w.e.f. 30.6.2016.
